The decision in focus

Identify the unresolved dependency before changing price or assuming the buyer cannot close. Borrower, aircraft, contract, title, insurance and timing issues call for different responses.

Create a factual status map

Record what is complete, what evidence has been requested, who is responsible and the next expected action. Distinguish a missing document from an adverse decision, a pending inspection from rejection and an indicative quote from commitment. Do not use vague statements such as bank problem when the specific gap can be described through the appropriate authorized channel.

Separate the workstreams

A borrower issue is different from a valuation gap, aircraft-condition finding, lien release, entity inconsistency or expired rate lock. Ask the buyer's advisers to identify relevant closing conditions while preserving private financial information. Seller-controlled records, payoff and authority items should be addressed on their own merits rather than used to speculate about the buyer's finances.

Evaluate remedies with the right people

Additional evidence, revised timing, repair, price change, different structure or ending the transaction may be discussed under the agreement. Counsel should review rights and obligations; the lender decides its conditions. A price reduction may address one economic issue without resolving airworthiness or title, so confirm the proposed remedy actually closes the identified gap.

Make the next decision dated and explicit

Agree a reasonable next milestone and communication owner through the appropriate process. Update carrying costs, payoff and contingent commitments. Retain amendments and avoid assuming silence grants an extension. If the parties decide to remarket or terminate, follow professional advice and existing obligations rather than treating frustration as a substitute for contractual action.

Illustrative seller scenario

Illustrative only: closing stalls because a prior recorded interest lacks release evidence, although the buyer's credit review is complete. Reducing price does not supply the missing release. The seller and title team should pursue the evidence and revise dates through the agreed process while the buyer updates any time-sensitive financing conditions.
