For current acquisitions, read the operative twelve-month aircraft provisions rather than older ninety-day examples. Ownership residence, California property tax and actual presence can matter.
Start with the operative provision
Regulation 1620 contains historical rules as well as current provisions. Its twelve-month subsection applies to the current acquisition period and addresses aircraft purchased outside California, first functionally used outside California and brought into the state within twelve months of purchase. An old article mentioning ninety days should not become the basis for a present closing plan without checking operative law and purchase date.
Identify the California connections
The regulation lists connections that can trigger a rebuttable presumption, including California residence, aircraft property-tax exposure in the initial ownership period and sufficient California use or storage by a nonresident. It also addresses closely held corporations and LLCs with California-resident ownership. Forming an entity in another state does not by itself answer whether the relevant residence condition applies to the aircraft acquisition.
Respond with coherent evidence
Rebuttable does not mean irrelevant. A buyer claiming purchase for use outside California needs documentary support consistent with the actual transaction and operations. Establish a record of locations, flight hours, storage, insurance, maintenance and purpose. Have the adviser identify which evidence addresses the specific claim. Simply accumulating receipts without a timeline makes later review harder and may leave important periods unexplained.
Manage the first ownership year
Create a monthly review with the management company or flight department. Compare the planned mission mix with actual use and notify the adviser of changes. Keep the filing calendar separate from the measurement period: a payment or claim deadline can arise before all supporting evidence exists. The adviser should decide how to submit available records and supplement them when appropriate.
A practical planning exercise
Illustrative issue: a California-owned LLC is organized elsewhere and acquires a jet outside the state. Before treating it as a nonresident acquisition, examine ownership and the regulation with counsel. The incorporation address alone is not the answer.
Your next-step checklist
- Confirm purchase date and operative subsection.
- Map ownership and basing.
- Maintain an evidence timeline.
- Track filings separately.
