The decision in focus

An interstate itinerary must be analyzed by purpose and flight time. Personal trips across state lines are not automatically commercial use for the aircraft exclusion.

Use the aircraft-specific measurement

CDTFA describes potential treatment involving delivery and first functional use outside California, followed by a specified interstate or foreign commercial flight-time test during the six months immediately after initial California entry. The aircraft calculation concerns flight time, not vehicle miles or vessel nautical miles. Keep the first-year presumption and six-month commercial-use analysis clearly labeled so their periods and units are not mixed.

Substantiate business purpose

The regulation uses commercial to refer to business use and excludes personal use in this context; it is not simply another word for a Part135 charter flight. Record the business purpose of each claimed flight and retain meeting records or correspondence. A personal weekend trip to Nevada should not be counted as commercial time merely because it crosses a state boundary.

Reconcile independent records

The supporting file should allow an adviser to reconcile flight entries, cumulative hours, maintenance time records and the timing of initial entry. Track aircraft identity consistently. A summary can explain the calculation but should not replace underlying records. Ask how repositioning, mixed-purpose travel and interconnected itinerary legs are treated before assuming they contribute to a qualifying numerator.

Test the operating plan

Do not build an acquisition budget around a mission mix unlikely to occur. Compare actual business needs with the intended schedule and ask how reduced travel would affect the analysis. Include liquidity for an unfavorable tax result. The calculator should accept an adviser-confirmed assumption and show its cash impact without deciding whether the use qualifies. Revisit the assumptions when the operating plan changes.

A practical planning exercise

Illustrative worksheet: list flights during the relevant period, actual hours, itinerary, purpose and evidence link. Leave uncertain classifications for review. Sum only adviser-approved categories; the percentage alone does not establish eligibility.

Your next-step checklist

  • Identify initial California entry.
  • Classify purpose per flight.
  • Use flight time consistently.
  • Retain logs and supporting evidence.
