A family relationship does not make every aircraft transfer nontaxable. Review the exact parties, consideration, qualifying relationship and documentation before changing ownership.
Identify the actual transaction
A sale, gift, transfer subject to debt and contribution to an entity can have different consequences. Start with legal owner, recipient, consideration and existing loan. If a family member pays or assumes debt, do not describe the entire transfer as a simple no-consideration gift without review. The lender also needs to assess transfer restrictions and any requested release of the existing borrower or guarantor.
Check the specific relationship
CDTFA lists particular qualifying family relationships and conditions, rather than a broad relatives exemption. The guide distinguishes biological or adopted relationships, certain step relationships and former spouses, and requires that the transferor not be engaged in selling aircraft for the identified family-sale treatment. An LLC owned by relatives is not automatically identical to a direct transfer between individual family members. Ask the adviser to analyze the parties actually named.
Preserve supporting records
Keep relationship evidence, the transfer agreement, bill of sale, valuation support, debt information and any tax filing analysis. FAA ownership evidence and registration requirements remain relevant even if a tax exclusion applies. The insurance broker needs the updated owner and operating arrangement. A family understanding written in email may not be sufficient to align registration, lender security and the formal transfer of title.
Coordinate several tax systems
Sales/use tax, federal gift reporting, income-tax basis and eventual sale treatment are separate questions. Obtain professional guidance for each relevant issue instead of applying one favorable answer across all systems. Ask who receives historic records and how the recipient will substantiate basis and operating use later. Planning the eventual documentation now is easier than reconstructing it years after the transferor has disposed of the aircraft files.
A practical planning exercise
Illustrative issue: a parent proposes transferring a jet to a child-owned LLC while a loan remains outstanding. Review the entity, debt and documents rather than applying the direct-family-sale rule merely because the individuals are related.
