The decision in focus

Taking delivery outside California is one fact in the tax analysis. Buyers also need a documented first use, entry timeline and actual operating pattern.

Document the legal handover

A delivery plan should align the contract, title transfer, acceptance and physical location of the aircraft. Record the date, airport, aircraft serial number and people signing the acceptance. Keep the seller statement alongside the closing documents and flight records. A fuel receipt is useful corroboration but does not by itself explain when ownership passed or why the aircraft was delivered at that airport.

Separate delivery and functional use

CDTFA distinguishes delivery from first functional use. The regulation describes functional use as use for the purpose for which the property was designed. A positioning or acceptance event should not automatically be characterized by a website as qualifying first use. Describe the proposed sequence to an aviation tax professional before travel begins, including passengers, business purpose and planned first California entry.

Plan for what happens after closing

A buyer returning to California shortly after an out-of-state closing may still fall within the current twelve-month presumption framework. For a proposed exclusion, the later flight pattern and supporting records can be critical. Maintenance visits, family travel and changed business missions should be discussed before they occur. A delivery plan is incomplete if its only instruction is to cross a state line.

Give the closing team one sequence

Give the lender, escrow agent, insurance broker, crew and tax adviser the same written plan. Confirm when coverage begins, when funds can be released and what evidence must be preserved. If an inspection discrepancy or weather delay changes the sequence, ask the advisers to reassess it. The crew must retain authority to make safe operating decisions independently of the tax plan.

A practical planning exercise

Illustrative sequence: agreement Monday, acceptance outside California Thursday, first intended business trip Friday and California entry Sunday. Place each event on a worksheet with its evidence. The worksheet returns questions for an adviser rather than an exemption verdict.

Your next-step checklist

  • Match acceptance and title documents.
  • Record first use and first entry separately.
  • Preserve flight evidence.
  • Reassess changed itineraries.
