A lease can change payment timing and operational responsibilities without removing California tax analysis. Review the acquisition and lease structure together before comparing it with a loan.
Describe the complete arrangement
Identify the owner, lessee, operator, management company, crew provider and people using the aircraft. List deposits, rent, reserves, purchase options and end-of-term obligations. A financing lease, operating arrangement and short-term aircraft rental are not interchangeable labels. The adviser needs the actual contract and intended use, not only a marketing summary. A loan comparison using only the monthly payment can omit substantial lease cash flows.
Obtain the sales/use-tax treatment
Regulation1660 addresses California leases of tangible personal property and includes conditions affecting how tax applies. Have an aircraft tax professional identify the relevant provisions for the lessor purchase, lease receipts and any later purchase. Do not promise that leasing spreads every tax or avoids tax. Record whether a quote includes applicable tax, who collects it and how a change of base or use will be handled.
Separate operational and tax classification
A lease described as dry should also be reviewed under FAA operational-control principles. The tax treatment of rent does not determine FAA authority to transport passengers. Federal air-transportation excise taxes involve another analysis, including the relationship between owner, manager and actual aircraft used. Ask for separate findings rather than using a single word such as lease to imply every regulatory and tax issue is resolved.
Compare full ownership-period cash flows
Use the same holding period, utilization, maintenance assumptions and end condition for lease and loan scenarios. Include deposits, return conditions, option amounts and assumed tax payments. Identify who benefits from or bears residual value changes. A favorable first-year payment can conceal a costly exit. Maintain a conservative case if an assumed tax treatment is still under review so the decision remains affordable under less favorable facts.
A practical planning exercise
Practical comparison: place loan payments, lease rent, deposits, reserves, taxes and exit amounts into dated cash-flow rows. Mark unverified tax entries as assumptions. Compare total cash obligations without claiming the calculation establishes lease classification.
Your next-step checklist
- Map all parties.
- Obtain tax-inclusive quote.
- Confirm operational control.
